1Acceptance of Terms

By creating an account, accessing, or using Chiloso Services, you acknowledge that you have read, understood, and agree to be bound by:

• These Terms of Service
• Our Privacy Policy
• Any additional terms applicable to specific features or services

Your continued use of the Services following any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Services immediately.

2Eligibility Requirements

To use Chiloso Services, you must meet ALL of the following requirements:

Our Policy Towards Children

Our Services are NOT directed to individuals under the age of 18. We do not knowingly collect or solicit personal information from anyone under 18.

If we learn that we have collected personal information from a child under 18, we will delete that information immediately. If you believe a child under 18 has provided us with personal information, please contact us at supportminors@chiloso.com.

3Account Registration and Security

Account Creation

To use Chiloso Services, you must create an account by providing accurate, complete, and current information, including:

• Unique username
• Valid email address
• Date of birth (for age verification)
• Secure password
• Location (city and state)

Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use of your account

Accurate Information

You agree to provide truthful, accurate, and complete information during registration and to keep your profile information up to date. Misrepresentation of your identity, age, or any other information may result in immediate account suspension or termination.

4User Conduct and Community Rules

When using Chiloso Services, you agree to:

• Treat all members with respect, dignity, and courtesy
• Be honest and truthful in your profile and communications
• Use the Services only for meeting other people in a personal and romantic manner
• Comply with all applicable local, state, national, and international laws
• Respect the privacy and intellectual property rights of others
• Report inappropriate behavior or content
• Exercise caution and common sense when interacting with other users

5Prohibited Activities

Misrepresentation and Fraud

• Misrepresenting your identity, age, location, affiliations, or any other personal information
• Impersonating any person or entity
• Using photos of someone else or deceptive photos
• Creating multiple accounts or fake accounts

Harmful or Illegal Activities

• Using the Services for any harmful, illegal, or nefarious purpose
• Harassing, bullying, stalking, threatening, assaulting, defaming, or harming any person
• Engaging in unauthorized commercial activity or spam
• Soliciting money, financial information, or personal data from other users
• Transmitting or soliciting unsolicited explicit sexual material
• Engaging in any form of human trafficking or exploitation

Technical Violations

• Uploading viruses, malware, or malicious code
• Compromising the security of the Services
• Using bots, scrapers, or automated systems to access the Services
• Reverse engineering, decompiling, or disassembling any part of the Services
• Circumventing security or age verification measures

Intellectual Property Violations

• Infringing copyrights, trademarks, or other intellectual property rights
• Using Chiloso content without express written authorization

6User Content and Intellectual Property

Your Content

You retain ownership of all content you upload, post, or provide on Chiloso Services ("Your Content"), including photos, videos, text, bio, and messages.

License Grant to Chiloso

By providing Your Content on the Services, you grant Chiloso a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display Your Content in connection with operating and promoting the Services.

Your Responsibility

Content Monitoring and Removal

Chiloso reserves the right, but not the obligation, to monitor, review, and remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion. We do not guarantee that we will review all content before it is posted.

7Prohibited Content

• Is sexually explicit, obscene, pornographic, or contains nudity
• Is violent, graphic, or otherwise may offend human dignity
• Is defamatory, libelous, or untrue
• Is abusive, insulting, threatening, or discriminatory
• Promotes or encourages racism, sexism, hatred, or bigotry
• Depicts or promotes illegal activities
• Contains personal information of others without their consent
• Infringes intellectual property rights
• Contains commercial advertising or spam

8Reporting and Safety

Report Inappropriate Behavior

Chiloso does not tolerate inappropriate content or behavior on our Services. We encourage you to report any inappropriate content or misconduct by other users.

No Background Checks

9Subscriptions and Payments

Subscription Plans

Chiloso may offer paid subscription plans that provide access to premium features. Pricing, duration, and feature details are clearly displayed before purchase.

Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless canceled
• You will be charged the then-current subscription price at each renewal
• You may cancel your subscription at any time through your account settings
• Refunds are subject to our refund policy and applicable laws

Payment Processing

Payments are processed securely by third-party payment processors. By providing payment information, you authorize Chiloso to charge the applicable subscription fee to your payment method.

10Account Termination

Termination by You

You may delete your account at any time using the "Delete My Account" feature in your profile settings.

Termination by Chiloso

Chiloso reserves the right to suspend or terminate your account at any time, without prior notice, if:

• You violate any of these Terms
• You no longer meet eligibility requirements
• Your account has been inactive for an extended period
• Your behavior is harmful to other users or the platform
• At our sole discretion, for any reason

11Disclaimers and Warranties

Chiloso expressly disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of user content
• Warranties that you will find a successful romantic match

12Limitation of Liability

In no event shall Chiloso's total liability to you for all damages, losses, and causes of action exceed the amount you paid to Chiloso in the last twelve (12) months, or $100, whichever is greater.

13Indemnification

You agree to indemnify, defend, and hold harmless Chiloso Citas, LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

• Your violation of these Terms
• Your misuse of the Services
• Your Content
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any claim that Your Content caused damage to a third party

14Modifications to Terms

Chiloso reserves the right to modify or change these Terms at any time. When we make material changes, we will notify users by updating the "Last Updated" date at the top of these Terms and, where appropriate, provide additional notice (such as adding a statement to our homepage or sending an email notification).

Your continued use of the Services after any modifications become effective constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Services immediately.

15Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except as otherwise provided in these Terms.

Class Action Waiver

You agree that any arbitration or litigation proceeding will be limited to the dispute between you and Chiloso individually. You waive your right to participate in a class action or representative action.
